Terms of Use

These terms govern your use of the Aegis DPO website and, where applicable, your participation in the early access programme. Please read them before submitting an application or using any part of the platform.

About these terms

These Terms of Use ("Terms") govern your access to and use of the Aegis DPO website at aegisdpo.com (the "Site") and, where you have been accepted into the early access programme, the Aegis DPO Platform (the "Platform").

The Site and Platform are operated by DPMAS — Data Privacy & Management Advisory Services ("DPMAS", "we", "us", "our"), a data protection consultancy based in Bridgetown, Barbados.

By accessing the Site, submitting an early access application, or using any part of the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Site or Platform.

Who may use this site

The Aegis DPO Site is publicly accessible and intended for use by data protection professionals, business owners, compliance officers, legal professionals, and government representatives operating in or interested in Caribbean data protection law.

To apply for early access to the Platform, you must:

  • Be 18 years of age or older
  • Be acting in a professional or organisational capacity, not as a private individual consumer
  • Have a legitimate professional interest in data protection compliance
  • Provide accurate and complete information in your application

We reserve the right to reject or revoke early access at our sole discretion, including where we determine that information provided in an application was inaccurate or misleading.

Early access programme

The Aegis DPO Platform is currently in an early access phase. Early access is by invitation only, following a review of submitted applications. Acceptance is at DPMAS's sole discretion.

By participating in early access, you agree to the following:

  • No commercial licence: Early access is provided for evaluation and feedback purposes only. You are not granted a commercial licence to use the Platform for client-facing services during early access unless separately agreed in writing with DPMAS.
  • Feedback: You agree to provide honest feedback on Platform functionality when reasonably requested. This is the consideration for early access participation.
  • Confidentiality: The Platform, its features, module design, and any unreleased functionality you access during early access are confidential. You agree not to disclose, publish, or reproduce these without prior written consent from DPMAS.
  • No payment: Early access participation is provided at no cost. No payment is required and no refund obligations arise.
  • Termination: DPMAS may terminate early access at any time with reasonable notice. You may withdraw from the programme at any time by contacting us at [email protected].

Note: Early access platform features, module availability, and the user experience are subject to change during the early access period. We will communicate material changes to participants directly.

Intellectual property

All content on this Site and within the Platform — including but not limited to text, design, code, graphics, module frameworks, document templates, compliance logic, and the Aegis DPO name and logo — is the intellectual property of DPMAS and is protected under applicable intellectual property law.

You are granted a limited, non-exclusive, non-transferable licence to access and use the Site for the purposes described in these Terms. This licence does not permit you to:

  • Copy, reproduce, or distribute any content from the Site or Platform for commercial purposes
  • Reverse engineer, decompile, or attempt to extract source code from the Platform
  • Use Aegis DPO branding, the shield logo, or the DPMAS name without prior written consent
  • Scrape or systematically extract content from the Site using automated means

Document outputs generated by the Platform using your own organisational data belong to you. DPMAS retains ownership of the underlying template logic, structure, and compliance frameworks.

Platform content and accuracy

Aegis DPO is built to reflect the requirements of the Barbados Data Protection Act 2019, Jamaica Data Protection Act 2020, and Grenada Personal Data Protection Act 2023. We take significant care to ensure that compliance logic, deadlines, and regulatory references are accurate.

However, data protection law evolves. Regulatory guidance is updated. Enforcement decisions create new precedent. DPMAS cannot guarantee that all platform content reflects the most current regulatory position at every moment.

We review platform content regularly and update compliance logic in response to material regulatory developments. Early access participants will be notified of changes that affect their compliance workflows.

Not a substitute for professional advice

The Aegis DPO Platform is a compliance management tool. It is designed to support Data Protection Officers and compliance professionals in structuring and managing their organisations' compliance programmes.

Important: Nothing on this Site or within the Platform constitutes legal advice. The Platform does not create a solicitor-client or adviser-client relationship between you and DPMAS. If you require legal advice on data protection matters specific to your organisation, you should consult a qualified legal practitioner.

Prohibited conduct

When using this Site or the Platform, you agree not to:

  • Use the Site or Platform for any unlawful purpose or in violation of any applicable law or regulation
  • Submit false, misleading, or fraudulent information in any form or application
  • Attempt to gain unauthorised access to any part of the Platform or its underlying infrastructure
  • Introduce malicious code, viruses, or disruptive software of any kind
  • Use the Platform to process personal data that you do not have lawful authority to process
  • Share early access credentials with individuals who have not been accepted into the programme
  • Disparage, defame, or misrepresent DPMAS, Aegis DPO, or the Platform in any public forum

DPMAS reserves the right to suspend or terminate access for any user who violates these prohibitions, without notice and without liability.

Third-party links

This Site may contain links to third-party websites, including the Office of the Data Protection Commissioner of Barbados, the Jamaica Office of the Information Commissioner, and other regulatory or reference resources.

DPMAS does not control third-party websites and is not responsible for their content, availability, or privacy practices. A link to a third-party site does not constitute endorsement of that site or its content.

Limitation of liability

To the fullest extent permitted by applicable law, DPMAS excludes all liability for loss or damage arising from your use of the Site or Platform, including but not limited to:

  • Reliance on any content, compliance guidance, or document output generated by the Platform
  • Any interruption, suspension, or discontinuation of the Site or Platform
  • Unauthorised access to or alteration of your data arising from circumstances beyond our reasonable control
  • Any indirect, incidental, or consequential loss of any kind

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraudulent misrepresentation, or any other liability that cannot be excluded or limited by applicable Barbados law.

Governing law and jurisdiction

These Terms are governed by and construed in accordance with the laws of Barbados. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Barbados.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

Changes to these terms

We may update these Terms from time to time. Material changes will be communicated to early access participants by email. The "Last updated" date at the top of this page will be revised accordingly.

Continued use of the Site or Platform after the effective date of updated Terms constitutes acceptance of those changes. If you do not agree with any revision, you should discontinue use and notify us at [email protected].
